YOU, THE BUYER, MAY CANCEL THIS AGREEMENT, WITHOUT ANY PENALTY OR OBLIGATION, AT ANY TIME PRIOR TO MIDNIGHT OF THE ORIGINAL CONTRACT SELLER'S THIRD BUSINESS DAY FOLLOWING THE DATE OF THIS CONTRACT, EXCLUDING SUNDAYS AND HOLIDAYS. To cancel this agreement, send an email which states that you, the buyer, are canceling this agreement, or words of similar effect. This notice shall be sent to: Found Social Club, at help@foundsocialclub.com.
NEW YORK MEMBERS: YOU, THE BUYER, MAY CANCEL THIS CONTRACT WITHOUT ANY CANCELLATION FEE WITHIN THREE (3) BUSINESS DAYS AFTER THE DATE OF THIS CONTRACT. SEE THE NOTICE OF CANCELLATION IN THE NEW YORK RESIDENTS SECTION OF THESE TERMS FOR AN EXPLANATION OF THIS RIGHT.
Found is a mobile app operated by Found Social Club, a California corporation ("we," "our," or "us"). In these Terms, "Found" refers to the app and the services provided through it. You accept these Terms by affirmatively agreeing to them when you create your account. The signup flow presents these Terms of Service ("Terms") and our Privacy Policy, and completing signup is your agreement to both, along with our Community Guidelines. We keep a record of the version you accepted and when you accepted it. If you do not agree, do not create an account or use Found. We may update these Terms from time to time. If we make a material change, we will notify you in the app and ask you to accept the updated Terms; the updated version applies to you once you accept it. For minor changes, such as clarifications or corrections that do not affect your rights, we will post the updated Terms here with a new version date. We keep a record of every version and of each member's acceptance.
Found is a sapphic-centered community: a dating and social app built around queer women and sapphic people of all identities, where everything from matching to events exists to serve that purpose. To create an account, you must: • Be at least 18 years old • Be legally permitted to use the app under applicable law • Not have been previously banned or removed from Found • Not have been convicted of a crime involving violence, sexual misconduct, exploitation, or abuse of another person By creating an account, you confirm that all of the above apply to you, and you agree to participate in good faith in a community centered on sapphic connection: present yourself authentically, and respect the community and its purpose. Every application is reviewed by our team, and we may approve or decline any application, and remove any account, at our discretion, consistent with these Terms and Found's community purpose. We also reserve the right to verify eligibility, and to remove accounts that do not meet these requirements, misrepresent themselves, or use Found contrary to its community purpose. Found does not routinely screen members or conduct formal criminal background checks, and membership is not a guarantee of anyone's history, intentions, or conduct. You are responsible for your own safety when meeting other members in person. If we remove your account under this section and you believe we made a mistake, email help@foundsocialclub.com and we will review the decision.
You are responsible for: • Providing accurate, current, and complete information on your profile • Using a real photo of yourself as your primary profile photo • Keeping your account credentials secure • All activity that occurs under your account You may not create an account for anyone other than yourself. You may not share your account with another person. You may have only one active Found account at a time.
To protect the safety and integrity of our community, Found requires new members to submit a selfie photo as part of the account approval process. Your consent to face data processing is not given here. Before your camera opens, the app shows you a separate Biometric Data Notice and asks you to agree to it on its own. That notice — not these Terms — is the release governing our collection and use of your face data, and nothing is collected or processed until you give it. You can read it in full in our Privacy Policy, and you are free to decline, though you will not be able to complete verification without it. When you submit a selfie, you understand that: • Your selfie is stored securely in a private, encrypted storage system and is never visible to other members • Found and its authorized administrators may review your selfie to confirm it matches your profile photos • Found uses automated facial recognition technology provided by Amazon Web Services (Amazon Rekognition) — both face detection and face comparison — to assist with this verification process Your selfie is used only for photo verification: confirming that you match your profile photos. It is not used for advertising, profiling, or shared with third parties beyond the service providers necessary to operate this feature. You may request deletion of your selfie at any time by contacting privacy@foundsocialclub.com. Deleting your selfie may affect your verified status.
Found is a community built on respect. You agree not to: • Misrepresent your identity, age, or any information on your profile • Submit someone else's photo as your selfie or profile photo • Harass, bully, intimidate, stalk, threaten, or harm other users • Send unsolicited explicit content • Use Found for commercial solicitation, advertising, or spam • Impersonate any person or entity • Post content that is hateful, discriminatory, violent, or illegal • Scrape, copy, or replicate Found's data, profiles, or features • Attempt to reverse engineer, hack, or compromise Found's systems • Create accounts after being banned • Solicit money or anything of value from another member • Use Found in connection with fraud, a pyramid scheme, or similar practice • Submit a report about another member that you know is false or made in bad faith Violations may result in immediate account termination without notice or refund.
You own the content you submit to Found (photos, bio, messages). So that Found can work, you grant us a non-exclusive, worldwide, royalty-free license to host, store, transmit, and display that content, limited to these purposes: operating the service, delivering your content to the people you direct it to (your messages are displayed only to their intended recipients), moderating and enforcing our rules, securing the service, and complying with the law. This license ends when you delete the content or your account, except for the copies and records our Privacy Policy says we retain. We do not sell your content, and we do not use your photos or messages in advertising or marketing without your separate permission. You are solely responsible for the content you post. You confirm that you have the right to share any photos you upload, that they are accurate representations of you, and that they do not infringe any third-party rights or violate any applicable law. We may remove content that violates these Terms or our Community Guidelines without prior notice.
Found's core features work like this: • Swipe on other members' profiles at nearby events. If you both like each other, you're matched. Matches can message each other in Found's chat, with no time limit or expiration. • Direct Connect lets you message someone directly without waiting for a mutual match. You can send one Direct Connect per person — if they don't respond, you can't send another until they do. • Found Elite members receive Direct Connect credits each month, on a rolling cycle tied to your own Elite start date rather than the calendar month. Additional Direct Connects can be purchased individually or in packs. • Event Passes can be purchased to unlock certain features for a specific event. Found is not responsible for the conduct of its members during in-app conversations or in-person meetings. Always prioritize your personal safety when meeting someone new — see Safety and reporting below.
Found is built around real-world events — concerts, sports, and community gatherings. Events come from public ticketing platforms like Ticketmaster, from community members, and from verified organizers through our Organizer Portal. If Found Social Club itself hosts an event, the event page will say so. Unless an event page says Found Social Club is the organizer, Found does not own, operate, host, or control the event, and is not responsible for its cancellation, safety, quality, or the conduct of its organizers or attendees. Event organizers are independent third parties, not Found employees or agents. Ticket purchases for third-party events happen on that organizer's or platform's own site; Found is not a party to that transaction and is not responsible for refunds, ticket validity, or venue conditions. Event Passes. An Event Pass is an in-app feature unlock for one specific event. It is not a ticket, it does not reserve you a spot, and it does not guarantee admission to the event. What it unlocks is what the purchase screen describes: seeing who liked you, Direct Connects usable at that event, and the attendee list once the event ends. If the event is rescheduled, your pass follows the event. If the event is cancelled or removed from Found before it ends, email help@foundsocialclub.com and we will give you equivalent access or help you request a refund from Apple. An Event Pass also does not promise that any particular number of members will attend an event or appear in the attendee list. When you RSVP to an event, other attendees of that event may be able to see that you're going, and attendees of the same event with Elite or an Event Pass may be able to view the attendee list, including after the event ends. Organizers can see how many people RSVP'd, but not who, unless you separately match or connect with them. By attending any event you find through Found, you're meeting other attendees at your own risk, in person, off of Found's platform, and you're responsible for your own safety and conduct there.
Found offers optional paid features through Apple's in-app purchase system, including: • Found Membership (Elite) — a recurring subscription unlocking priority visibility, incognito browsing, additional Direct Connects each month, and other Elite features • Direct Connect credits — one-time purchases that let you message a specific person before matching • Event Passes — one-time purchases that unlock certain features for a specific event All purchases are subject to Apple's payment terms. • Subscriptions automatically renew until cancelled • Cancel before the renewal date to avoid being charged for the next period • To cancel: iPhone Settings → Apple ID → Subscriptions → Found • Purchases are generally non-refundable except as required by law or Apple's own refund policies Refunds. Purchases are made through Apple, and Apple issues the refunds. Request one at reportaproblem.apple.com, or through Settings → Apple ID → Subscriptions on your device. California members: your three-day right to cancel under "California residents" below is not limited by anything in this section, and cancelling does not depend on Apple approving a refund. Direct Connect credits and Event Passes are non-transferable, tied to your account, and have no cash value. Direct Connect credits you purchase do not expire. The monthly credits included with Elite refresh each billing cycle, and unused ones do not carry over. An Event Pass's Direct Connects can be used only at the event the pass was purchased for.
California's Dating Service Contract Act (Civil Code §1694 and following) gives California members rights that apply on top of anything else in these Terms. Nothing here waives them, and any attempt to waive them is void. Your three-day right to cancel. You may cancel, without penalty or obligation, at any time before midnight of the third business day following the date of your purchase, excluding Sundays and holidays. The notice at the top of these Terms says this in full. How to cancel. Email help@foundsocialclub.com saying that you are cancelling. Your cancellation takes effect when you send that email — you do not need us to reply, and you do not need to use any particular wording. You may also cancel a subscription through Apple, but you are not required to go through Apple to exercise this right. Your copy of this contract. You may request a retainable copy of these Terms at any time by emailing help@foundsocialclub.com, and a print-friendly copy is always available at foundsocialclub.com/terms.html. If you die. If a member dies during the term of a paid subscription, the subscription is cancelled and the member's estate is released from any further payment. Anything already paid for services not yet received is refunded to the estate. Write to help@foundsocialclub.com. If you become disabled. If you become disabled during the term of a paid subscription such that you cannot use the service, you may cancel and receive a refund of anything paid for services you have not received. We may ask for written verification from a physician you choose and pay. If that physician expects the disability to last less than six months, we may extend your subscription by six months at no charge instead of cancelling it — your choice of which you prefer. If you move. If you move and can no longer reasonably use Found, you may cancel and receive a refund of anything paid for services not yet received. Found is an online service available anywhere we operate, so this will rarely apply, but the right is yours if it does. Staying safe. Found publishes dating safety guidance in the app under Profile → Safety, covering meeting in public, telling someone where you're going, trusting your instincts, and how to report someone. Please read it before meeting anyone in person. Refunds. Purchases are made through Apple's in-app purchase system, and refunds are issued by Apple, not Found. To request a refund — including after cancelling under this section — go to reportaproblem.apple.com and choose "Request a refund," or use Settings → Apple ID → Subscriptions on your device. You can also get help at getsupport.apple.com. Complaints. Under California Civil Code §1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N112, Sacramento, CA 95834, or by phone at (800) 952-5210.
New York's social referral service law (General Business Law §394-c) gives New York members rights that apply on top of anything else in these Terms. Nothing here waives them. Your three-day right to cancel. You may cancel a paid subscription contract, without any cancellation fee, penalty, or obligation, within three business days after the date of your purchase. Email help@foundsocialclub.com saying that you are cancelling, or send the notice below. Any payments you made under the contract will be returned within ten business days after we receive your cancellation notice. NOTICE OF CANCELLATION. Date of transaction: the date you subscribed. YOU MAY CANCEL THIS CONTRACT, WITHOUT ANY PENALTY OR OBLIGATION, WITHIN THREE (3) BUSINESS DAYS AFTER THE DATE OF THIS CONTRACT BY EMAILING A SIGNED AND DATED COPY OF THIS CANCELLATION NOTICE, OR WORDS OF SIMILAR EFFECT, TO FOUND SOCIAL CLUB AT HELP@FOUNDSOCIALCLUB.COM, NOT LATER THAN MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DATE OF THIS CONTRACT. IF YOU CANCEL, ANY PAYMENTS MADE BY YOU UNDER THE CONTRACT WILL BE RETURNED WITHIN TEN (10) BUSINESS DAYS FOLLOWING RECEIPT BY THE SELLER OF YOUR CANCELLATION NOTICE. Consumer Bill of Rights. New York law entitles every purchaser to the Dating Service Consumer Bill of Rights. It is linked on the subscription screen and in Settings, and you can read it at any time. Your information. We will not sell, assign, or otherwise transfer information of a personal or private nature acquired from you, such as questionnaire answers or photographs, without your prior written consent. When your contract ends, for any reason, we delete that information and provide you certification of the deletion, unless a law, regulation, or court order requires us to retain it. Our Privacy Policy explains how deletion works. Membership hold. You may place your membership on hold for up to one year at no charge by emailing help@foundsocialclub.com. Paid time remaining on your subscription is preserved and resumes when the hold ends. Fraud bans. If we ban an account because, in our judgment, it used a false identity or posed a significant risk of trying to obtain money from members, we notify New York members who received and responded to a message from that account. The notice is sent within twenty-four hours of the ban, or up to three days where a different time is more effective, and includes the banned account's profile identifier, the reason for the ban, a reminder never to send money or personal financial information to another member, and a link to guidance on avoiding fraud.
You may delete your account at any time in Profile → Settings → Delete Account. Your profile is hidden from Found immediately and deleted 30 days later. You can restore it by logging back in during those 30 days; after that, your profile, photos, selfie, messages, and account data are erased from our servers and the deletion cannot be undone. A small set of records survives account deletion, each kept only as long as its purpose requires: consent and notice records (evidence that required notices were given and agreed to), safety reports and fraud-ban notice records, financial records that tax, accounting, or dispute rules require, material relevant to an active dispute, investigation, or legal hold, and residual copies in system backups until they cycle out. Our Privacy Policy describes each of these. Found reserves the right to suspend or permanently ban any account that violates these Terms or our Community Guidelines, at our sole discretion, without prior notice or refund. Banned users may not create new accounts. If you believe your account was suspended or banned in error, email help@foundsocialclub.com and we will review the decision. Upon termination your right to use Found ceases immediately. These sections survive termination: Limitation of liability, Indemnification, Binding arbitration, and Class action waiver.
If another member makes you feel unsafe or violates our guidelines, use the in-app Report button (tap the three-dot menu in any chat) or block them from their profile. You can also contact us directly at safety@foundsocialclub.com. This link navigates to Found's Safety Policy: foundsocialclub.com/safety-policy.html. It describes the conduct we prohibit, how we verify members, how reports and suspensions are handled, when we notify members who had contact with a removed account, and safety resources. It is also linked in Settings under Safety Policy. For urgent safety concerns, always contact local emergency services first.
Found does not conduct criminal background checks on its members, and does not verify any member's legal identity or age from identity documents. Photo verification, described above, confirms only that a member matches their profile photos. Neither photo verification nor any member's own representations are a guarantee of anyone's identity, age, criminal history, or safety. We do not otherwise investigate members' backgrounds, and we make no representations about any member's identity, intentions, or conduct. You are solely responsible for your own safety and judgment when interacting with other members, on or off the app. Always use caution, especially before meeting someone in person.
Found is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the app will be uninterrupted, secure, or error-free, or that profile information provided by other members is accurate. Photo verification reduces but does not eliminate the risk of encountering false or misleading profiles. We are not responsible for the behavior of other members, or of event organizers, whether inside or outside the app.
To the maximum extent permitted by law, Found shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including but not limited to damages from interactions with other members or attendance at any event. To the same maximum extent permitted by law, our total liability for any claim shall not exceed the amount you paid to Found in the 12 months preceding the claim, or $100, whichever is less. Nothing in this section limits liability that the law does not allow to be limited, including liability for our own fraud, gross negligence, or willful misconduct, and nothing in it waives rights that the law says cannot be waived, including the nonwaivable rights of California and New York members described in these Terms.
You agree to indemnify, defend, and hold harmless Found, Found Social Club, and our owners, officers, employees, and affiliates from claims brought by a third party, and the damages, liabilities, costs, and expenses (including reasonable attorney's fees) of those claims, to the extent they are caused by: content you submit that infringes someone's rights or violates the law; your material breach of these Terms; or your unlawful conduct or intentional misconduct, on or off the app. This obligation applies only to the extent permitted by law, and it does not cover claims to the extent they are caused by our own conduct.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of Found, including disputes about the validity, enforceability, or scope of this arbitration agreement, shall be resolved through final and binding individual arbitration rather than in court, except where this section says otherwise. You waive your right to a jury trial and your right to participate in a class action lawsuit or class-wide arbitration. Arbitration will be conducted by a neutral arbitrator under the Consumer Arbitration Rules of the American Arbitration Association (AAA), and this arbitration agreement is governed by the Federal Arbitration Act. The arbitration will take place in Los Angeles, California, and you may choose to attend any hearing by video or telephone instead of traveling there. Sexual assault and sexual harassment claims. Under the federal Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act, if your dispute involves a claim of sexual assault or sexual harassment, you may choose to bring that claim in court instead of arbitration. Nothing in these Terms takes that choice away from you. Public injunctive relief. Nothing in these Terms waives your right to seek public injunctive relief where the law gives you that right. Any claim for public injunctive relief will be decided by a court, even if the rest of your dispute is arbitrated. This arbitration agreement also does not apply to: (a) small claims court actions within applicable jurisdictional limits; (b) claims for injunctive or equitable relief to protect intellectual property rights; or (c) your right to report concerns to, file a complaint with, or participate in an investigation by any federal, state, or local government agency, which may be able to grant you relief regardless of this section. Talk to us first. Before starting an arbitration, you must email help@foundsocialclub.com a written notice describing the dispute and what you want, and give us 60 days to try to resolve it with you informally. Found must do the same before starting an arbitration against you. Any statute of limitations is paused during those 60 days, so this step never costs you your claim. Arbitration costs. You pay only your AAA consumer filing fee. Found pays all other arbitration fees, including AAA administrative fees and the arbitrator's fees, except where the AAA's own rules shift fees for a claim the arbitrator finds frivolous. Your right to opt out. You may reject this arbitration agreement entirely by emailing help@foundsocialclub.com within 30 days of first accepting these Terms. Say that you are opting out of arbitration and include the email address on your Found account. If you opt out, neither you nor Found can require the other to arbitrate. Opting out does not affect any other part of these Terms, and Found will never penalize you for it. Coordinated filings. If 25 or more demands for arbitration raising similar claims are filed by the same or coordinated counsel, the arbitrations will proceed in batches: ten will go forward first as test cases, and the rest will be paused, with their filing deadlines and limitation periods paused too, until the test cases finish. The parties will then use those results to try to resolve the remaining claims. This paragraph exists so that the merits, rather than the volume of filing fees, decide coordinated claims. If any part of this section other than the class action waiver below is found unenforceable, the rest of this section still applies.
You agree that any dispute resolution proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to bring or participate in a class action, class arbitration, or any other representative proceeding against Found. If this waiver is found unenforceable as to a particular claim, then that claim, and only that claim, must proceed in court rather than in arbitration, and the rest of these Terms still applies to it.
These Terms are governed by the laws of the State of California. To the extent any dispute is not subject to arbitration, it shall be resolved in the state or federal courts located in Los Angeles County, California. If you are located in the EU, UK, or EEA, nothing in these Terms affects your statutory rights under applicable consumer protection laws.
